General Manager’s approval, and no such advertisement will be displayed until that agreement has been given, but such approval will not be unreasonably withheld. D. The General Manager shall have the power to disallow any advertisements which he or the Tramway Committee considers to be objectionable, undesirable, indecent or seditious in character. E. All advertisements shall be displayed at the expense of the Contractor, and the Corporation shall not be held responsible for, or called upon to make good any damage or injury caused by the same by whatever means it may have been caused. The Corporation to allow the Contractor’s agents and servants, to access the tramcars at all convenient times, for the purposes of displaying, renewing or removing advertisements. F. All advertisements shall be displayed and maintained in good order, whether within or outside a car. They shall not damage any car or cause noise, rattle or vibration, and if so must be removed by the Contractor within three days of written notice. G. All outside advertisements must be enamelled and fixed in the spaces provided, and the inside advertisements must be on coloured glass of approved tints. Any damaged advertisements shall be replaced at the request of the General Manager, at the cost of the Contractor. H. The Corporation reserves the right to allow cars from other Corporations to operate over its tracks, and these shall not be included in this contract. (Cars from Blackburn and Rawtenstall operate from the respective boundaries to the Market Place in Accrington). I. The Contractor shall be responsible for any claims made against them for injury to the public, the servants of the Corporation for injury or damage. The Corporation may settle the latter and then demand the costs including all expenses from the Contractor. J. Advertisements shall not be allowed in other spaces except for those defined by this schedule, unless written consent is obtained from the General Manager beforehand. K. When there are not sufficient spaces available, the General Manager shall allot a space of equal dimensions in some alternative part of a car, and make a proportional rebate from the rent. L. The Corporation reserves the right to remove any advertisements from cars when they are required for special events, and reserves the right to display on cards suspended in the cars, for local events including sports, bazaars, theatrical entertainments and musical soirees. M. The Contractor shall on request remove all advertisements from a car, when that car is required for repainting, or repair from any damage. N. In the event of any accident occurring, or unforeseen contingency arising, which would prevent cars from being put out into service, the Contractor shall not claim a rebate, but in the case of a strike or other stoppages, the Corporation will grant a proportionate rebate. O. Tenders must be made as a lump sum per annum for the whole of the rights of this specification. P. The rents shall be paid quarterly, on the dates as specified. Q. The Contractor shall indemnify the Corporation against all infringements of copyright. R. The Contractor shall comply with the standard rates of wages and hours that are generally accepted by Accrington Corporation. S. Should the Corporation obtain new or additional cars during the duration of this contract, the Contractor shall be granted the same rights of access to advertise on these cars, with proportionate considerations as contained in the contract, for cars of a similar type. T. When the contract expires the Contractor shall remove the glasses and boards, (unless the Corporation decides to take them into stock at face value), at its own expense. The Contractor shall make good any damage caused during the display or removal of these glasses to the satisfaction of the General Manager. These shall be removed within 14 days of the contract expiring, and any not removed during the specified time shall automatically become the property of Accrington Corporation, and any expense incurred
